EU Economic Operator and GPSR Responsible Person

A product covered by the GPSR may be placed on the market only when an economic operator established in the EU is responsible for the Article 16 tasks for that product. What is EU GPSR compliance?

EU GPSR compliance means meeting the product-specific obligations that apply under Regulation (EU) 2023/988 and any other relevant EU product rules. Evidence can include risk assessment, technical documentation, traceability, labelling, and applicable tests or declarations. There is no single checklist or certificate that proves compliance for every product. Who is the Responsible Person under the GPSR?

The Responsible Person is the economic operator established in the EU who performs the relevant Article 16 tasks for a product covered by the GPSR. The person or company filling that function depends on the supply chain and the legally applicable role. Its name and contact details must be traceable, and distance-sale offers must also display the information required by Article 19 where the manufacturer is outside the EU.

Who can act as a Responsible Person?

Depending on the supply chain, the function may be performed by an EU-established manufacturer, an importer, an authorised representative appointed in writing, or, under the statutory conditions, a fulfilment service provider. The label alone is not decisive. The role must apply to the specific product under Article 16 GPSR together with the Market Surveillance Regulation. That assessment therefore needs the product, distribution model, and written mandate to be reviewed together.

Is a Responsible Person the same as an Authorised Representative?

No. “Responsible Person” describes the function that an EU economic operator must perform for a specific product under Article 16 GPSR. An Authorised Representative is a role created through a written mandate under a different legal framework and may, where the legal conditions are met, provide the economic-operator basis for that function. The terms are not interchangeable. The product, mandate, and applicable legislation must be reviewed before assigning either description.

Is there an official GPSR certificate?

There is no general-purpose GPSR certificate. Compliance is demonstrated through product-specific risk assessment, technical documentation, traceability, labelling, and applicable tests or declarations. Other EU legislation relevant to a particular product may additionally require certification or a conformity assessment. A commercially issued “GPSR certificate” is therefore not, by itself, proof that the product complies with all applicable requirements.

What information must appear in an online product offer?

Article 19 GPSR requires distance-sale offers to display the manufacturer’s name, postal address, and electronic address clearly. Where the manufacturer is not established in the EU, the Responsible Person’s name, postal address, and electronic address must also appear. The offer must identify the product, including an image and type or other identifier, and show applicable warnings or safety information in language consumers can readily understand.
